1. NOTICE TO USER

PLEASE READ THIS USER AGREEMENT CAREFULLY.

By installing, copying, or otherwise using RightNow websites or its software, you acknowledge that you have read and understood this user agreement and the RightNow Ministries Online User Agreement, and agree to be bound by the terms and conditions outlined in both. If you do not agree to (or cannot comply with) the terms and conditions of this agreement or the RightNow Ministries Online User Agreement, do not install, copy, or use the RightNow websites, software or any music, images, video, text, or other material available through the RightNow websites (“content”).

By registering or browsing the BSF Groups Online Platform, you acknowledge that you have read, understood, and agree to be bound by this agreement and the RightNow Ministries Online User Agreement. If you do not agree to these terms, you can stop using RightNow websites at any time.

2. DEFINITIONS

When used in this agreement, the following terms shall have the respective meanings indicated.

“RightNow Media” refers to the customisable online church video library accessed via the internet for which Shellharbour Community Church is licensed for the purposes of running training by members of the church.

“RightNow Ministries Online User Agreement” refers to the legal agreement between you and RightNow websites, which will be presented to each user upon being given access to RightNow Media with a user id and password.

“BSF Groups Online Platform” refers to the online Bible Study Group resources.

“Use” or “using” means to access, install, download, copy or otherwise benefit from using the functionality of the resource in accordance with the agreement.

“SCC” stands for Shellharbour Community Church

3. USER AGREEMENT

In signing this agreement, you also agree to the online RightNow Ministries Online User Agreement located on their web site, http://www.rightnowmedia.org/terms-of-use. You acknowledge that you have read, understood and will adhere to the terms and conditions therein.

In this agreement it states that users must be 13 years of age or older, and that all persons between the age of 13 and 18 need to have parental consent to register. (This does not mean that children under the age of 13 cannot see the resources run by a leader, it means they cannot be set up as a user.)

The agreement also states that “you represent, warrant, and agree that you are using the RightNow Websites for your own church/ministry use and not for redistribution of any kind” [in section “Description of the RightNow Websites”] This means no resource is to be distributed or posted to anyone outside of the church, and that we cannot set up users who are not members of the church. However, anyone in the wider community are welcome to attend a screening being held by a church member. For example, neighbours, visitors to the church, attendees at home group etc.

You may use any of the resources on any of the RightNow Media channels for your own personal development.

As part of your agreement with SCC, you agree that if you show a video from the Right Now Media library to any group of people, you commit to being accountable to your leader (connect leader, department leader or elder) by sending them an email with the details at least one week beforehand (describing author, title, location, time, group attending). The leader will then forward the information to the appropriate elder. (If you are unsure of the email address you can inquire at info@shellharbourcc.org.au). This enables the elder for each portfolio to be involved and provide support for training when needed, while also ensuring accountability with the various material being taught across different groups in the church. If the leader/elder does not respond to the email you may assume that you can go ahead with running the material. On occasions the elder may show their discretion by declining the course from being run if they feel the course is not appropriate at that time. By signing this agreement, you agree to abide by direction from the eldership team.

4. TERMINATION

SCC has the right to take any of the following actions in our sole discretion at any time and for any reason without giving you any prior notice:

Restrict, deactivate, suspend, or terminate your access to all or any part of the Site or RightNow Websites including deletion of your accounts and all related information and files in your account;

Refuse, move, or remove any material that you submit on or through the Site or RightNow Websites;

Block any material from being available through the Site or RightNow Websites; and/or

Establish general practices and limits concerning use of the RightNow Websites.

We may take any of the above actions for any reason, as determined by SCC in its sole discretion, including, but not be limited to, (a) breaches or violations of this Agreement or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you, (d) discontinuance or material modification to the RightNow Websites (or any part thereof), (e) unexpected technical or security issues or problems, or (f) other reasons deemed acceptable by SCC. You agree that SCC will not be liable to you or any third party for taking any of these actions. Except as otherwise provided herein, you may terminate this Agreement for any reason (or no reason) at any time upon written notice to us. Provisions regarding proprietary rights, termination, legal compliance, enforcement, third-party websites and content, disclaimers, limitations of liability, waivers, indemnity, notice, and any obligations to pay amounts due and owing prior to termination shall survive termination or expiration of this Agreement for any reason.

5. LIMITATION OF LIABILITY

In no event will SCC or any other party who has been involved in the creation, production, distribution, promotion, or marketing of the site or this agreement be liable to you or any other party for any special, indirect, incidental, reliance, exemplary, or consequential damages, including, without limitation, loss of data or profits, or for inability to use the site, even if SCC or such other party has been advised of the possibility of such damages. Such limitation shall apply notwithstanding any failure of essential purpose of any limited remedy and to the fullest extent permitted by law.
